Retaining Wall Inspections

Rule 103-09 went into effect January 1, 2014, requiring a condition assessment of all parts of retaining walls with any portion of the wall having a height of 10 feet or more at any location and fronting a public right of way.

The condition assessment must be performed by a Professional Engineer with no less than 3 years of relevant experience – once every 5 years. Close up inspection is required. Categories of ‘safe’, ‘safe with minor repairs or maintenance’, ‘safe with repairs and/or engineering monitoring’, or ‘unsafe’ must be used.

Filed reports must not describe the same condition pertaining to the same location on the retaining wall as ‘safe with repair and/or engineering monitoring’ for two consecutive report filing cycles.

A report must be generated by the Professional Engineer in the acceptable format and filed with the NYC DOB according to the following schedule:

Bronx January 1, 2014 – December 31, 2014
Manhattan January 1, 2015 – December 31, 2015
Staten Island January 1, 2016 – December 31, 2016
Queens January 1, 2017 – December 31, 2017
Brooklyn January 1, 2018 – December 31, 2018

Failure to File $1,000 per year + $250 per month.
